Digital Millennium Copyright Act (DMCA) Policy

The Haitian Media Streaming Network ("HMSN", "we", "us", or "our") respects the intellectual property rights of others and expects our users and broadcasting partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond expeditiously to claims of copyright infringement committed using the hmsnmedia.com website or our streaming applications (the "Service") that are reported to our Designated Copyright Agent.
1. Filing a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied or broadcasted in a way that constitutes copyright infringement through our Service, please submit a written notice to our Designated Copyright Agent containing the following information:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
- Identification of Infringing Material: A description of the material that you claim is infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL, the name of the live TV/Radio channel, or the specific broadcast time).
- Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Designated Copyright Agent
All DMCA Takedown Notices must be sent to support@hmsnmedia.com (Please include "DMCA Takedown Request" in the subject line).

Note: Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
3. Counter-Notice Procedures
If you believe that the material you posted or broadcasted was removed (or to which access was disabled) by mistake or misidentification, you may file a Counter-Notice with our Designated Copyright Agent. The Counter-Notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location (URL or channel) where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the US, the district where HMSN is located), and that you will accept service of process from the person who provided the original DMCA notice.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, HMSN has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users or broadcasting partners who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
