Welcome to the Haitian Media Streaming Network ("HMSN", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the hmsnmedia.com website, our mobile applications, and any live TV, radio, or video-on-demand services provided by HMSN (collectively, the "Service").

By registering an account, purchasing a subscription, or simply accessing the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

HMSN provides an online video and audio streaming platform offering live television, radio feeds, and other media content. The content, features, and user interface may be updated, changed, or removed at our sole discretion without prior notice.

2. User Accounts and Security

To access premium streams, you must create an account.

  • Age Requirement: You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and purchase a subscription.
  • Account Security: You are strictly responsible for maintaining the confidentiality of your login credentials.
  • No Account Sharing: Your HMSN account is for personal, non-commercial use only. You may not share your login credentials with individuals outside of your immediate household. We monitor simultaneous logins and reserve the right to suspend or terminate accounts that show evidence of unauthorized sharing or credential distribution.

3. Subscriptions, Billing, and Cancellation

  • Billing Cycle: HMSN offers premium access on a subscription basis. By providing a payment method, you authorize us (via our third-party payment processors, such as Stripe and MonCash) to charge your recurring subscription fee on a monthly (or otherwise agreed upon) basis.
  • Cancellation: You can cancel your subscription at any time through your Account Dashboard.
  • Refunds: All charges are non-refundable. We do not provide partial refunds or credits for mid-month cancellations or unwatched content. For full details, please review our cancellation policy.

4. Intellectual Property and Content Restrictions

All content delivered through HMSN, including live broadcasts, logos, UI designs, text, and software, is the property of HMSN or its licensed content providers and is protected by international copyright laws.

You explicitly agree NOT to:

  • Copy, record, capture, or download any live stream or video content from the Service.
  • Restream, redistribute, broadcast, or transmit the Service's content to any public viewing area, commercial establishment, or unauthorized third-party platform (e.g., YouTube, Facebook Live, unauthorized IPTV boxes).
  • Attempt to bypass, disable, or defeat any digital rights management (DRM), geo-blocking, or security systems protecting the streams.

Violation of this section will result in immediate permanent account termination without refund and may expose you to civil or criminal legal action.

5. Geo-Restrictions and Internet Usage

  • Content Availability: Certain TV or radio channels may be subject to geographic blackouts or licensing restrictions. We do not guarantee that all content will be available in all countries.
  • Data Charges: You are solely responsible for any internet connection fees, mobile data charges, or bandwidth overage fees incurred while streaming HMSN content.

6. Disclaimer of Warranties

The Service and all content are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide high-quality broadcasts, HMSN does not guarantee that the streams will be uninterrupted, buffer-free, or entirely secure. Live television is subject to technical difficulties, satellite feed drops, and network congestion out of our control.

7. Limitation of Liability

To the maximum extent permitted by law, HMSN, its parent companies, directors, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to lost data, loss of access, or financial loss.

8. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate your account without notice or liability if we suspect you have violated any of these Terms, engaged in illegal activities, or abused the Service (including excessive bandwidth consumption due to unauthorized scripting).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in the State of Florida.

10. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or by displaying a prominent notice on hmsnmedia.com. Your continued use of the Service after changes are published constitutes your acceptance of the new Terms.
